国外矿业权登记制度述评与启示

摘要

矿业权登记作为矿业权管理的重要组成部分,是获得矿产资源勘探或开采权利不可或缺的关键环节。文章对国外矿业权登记制度进行述评,重点对美国、澳大利亚、巴西、日本四国矿业权登记有关制度进行分析总结。国外矿业权登记制度值得的几个方面有益经验:健全的矿业权登记法律法规;登记机构设置简化、登记信息统一;矿业权登记管理信息公开,信息公示系统健全。
        As an important part of mining right management, mining right registration is an indispensable approach to acquire the right of exploration or exploitation of mineral resources. This paper reviews the foreign mining right registration system, emphasizes on the analysis and summary of the relevant systems of mining right registration in the United States, Australia, Brazil and Japan. Some beneficial experiences worthy of learning from foreign mining right registration system are as follows: Perfect laws and regulations of mining right registration; Simplification of registration institutions and unification of registration information; Disclosure of management information on registration of mining right and efficient information publicity system.
