原产地规则及其运用的法律问题研究

摘要

随着国际贸易和经济全球化的发展，原产地规则的作用日益增强，在国际贸易领域的适用范围不断扩展。它广泛适用于最惠国待遇、反倾销和反补贴措施、保障措施的具体实施及选择性实施、反规避、歧视性数量限制、关税配额、政府采购及贸易统计等非特惠制贸易措施领域中，因此，不就原产地标准确定统一规则，国际多边贸易协定所确立的原则及成员方的权利与义务以及促进国际贸易自由化的良好愿望都将大打折扣。同时，原产地规则在特惠制贸易安排(主要体现在区域经济一体化及发展中国家的普惠制)中也发挥着至关重要的作用，区域性贸易安排对国际贸易是发挥积极作用抑或产生消极影响，一个关键问题就是区域贸易安排中原产地规则的是否合理和统一。另外，原产地规则发展的一大趋势就是其运用的领域不再局限于货物贸易领域，而且逐渐向服务贸易和国际资本流动领域扩展。这些方面在本论文中都有阐述。
     本文共分为五大部分。第一大部分从原产地规则的含义、原产地规则的判定标准、原产地规则的种类及原产地规则的作用四个方面对原产地规则进行了基本的阐述，其中对原产地规则问题的实质和意义以及对原产地规则进行的经济分析是这部分的突出见解。
     第二大部分分析了国际层次上统一的原产地规则，对原产地规则在WTO法律体系中的运用的阐述是这部分的新创造。
     第三大部分分析了原产地规则在世界主要区域经济一体化中的运用。
     第四大部分探讨了原产地规则在服务贸易领域的运用，这是本论文的突出的创造性观点。
     第五大部分介绍了我国原产地规则的法律框架，提出了完善我国原产地规则的若干建议，具有积极的意义。
With the development of international trade and the integration of global economy, rules of origin are playing a more essential and important role on the international trade, whose scope of application are broader. They are used in non-preferential commercial policy instruments, such as most-favoured-nation treatment; anti-dumping and countervailing measures; safeguard measures; any discriminatory quantitative restrictions or tariff quotas. They are also used for government procurement and trade statistics. Thus, without the harmonized discipline to govern the application of rules of origin, the principles set in the international multilateral agreements will be impaired, so does the rights and obligations of the members and the aim to facilitate liberalization of world trade. In addition, rules of origin in preferential trade agreement, mainly in the Free Territory and GSP are also vitally important, for what kind of effects preferential trade agreement give to international trade depends on the reasonableness and harmonization of rules of origin. One important development trend of rules of origin is their application fields, which include not only international trade in goods also trade in services and investment. All subjects mentioned above are discussed in this paper.
    This paper divided into five parts. First part makes a general and basic description of rules of origin. This part includes four aspects, namely the concept and meaning of rules of origin, the origin criterion, the varieties of rules of origin and the positive and adverse effects of rules of origin. For these aspects, the analysis of substance and significance of the problem on rules of origin and the economic analysis of rules of origin are the most significant opinions.
    The second part of my paper analyses international harmonized rules of origin. The analysis of application of rules of origin in WTO legal system is a most important originative idea.
    The third part discusses the application of rules of origin in the integration of territory economics.
    The fourth part addresses the application of rules of origin in the trade in services.
    The fifth part introduces the legal framework of rules of origin in China and put forward the suggestions and opinions on the development of rules of origin in China. These suggestions and opinions are valuable and have realistic meaning.
