产业技术标准联盟专利冲突及其防范策略

摘要
产业技术标准联盟的专利冲突存在于各项专利活动之中,防范冲突发生是提高联盟效率的必然选择。通过分析产业技术标准联盟专利活动及存在的专利冲突,考虑冲突主体层次和矛盾焦点,将专利冲突划分为两个维度、四种类型,针对不同类型的冲突提出冲突防范策略,为产业技术标准联盟专利冲突管理提供参考。
The patent conflicts in industrial technology standard alliance exist in various patent activities,and the prevention of conflicts is the inevitable choice of improving the efficiency of the alliance. Through the analysis of patent activities in industrial technology standard alliances and the existing patent conflicts,and by considering the conflict subjects and contradiction focuses,this paper divides the patent conflicts into two dimensions and four types. Then the conflict prevention tactics is put forward according to different types of conflicts. This research may provide reference for industrial technology standard alliance to manage patent conflicts.
