相邻环境污染侵权之法律识别

摘要
环境污染问题日益增多,公民环境保护意识空前高涨。实践中,相邻环境污染侵权与环境污染侵权难以清晰区分。分析二者诉讼模式与空间差异,引入法律经济学原理,结合汉德法则与卡尔多-希克斯标准的启示,能够对相邻环境侵权纠纷和环境污染纠纷进行科学有效的区分。
As environmental pollution is increasing day by day, citizens' awareness of environmental protection is unprecedented. In practice, it is difficult to clearly distinguish infringement of adjacent environmental pollution and environmental pollution infringement. By analyzing the difference between litigation mode and space, and using the principle of legal economics, combined with the enlightenment of the Hand rule and the Cardo-Hicks Standard, this article made a scientific and effective distinction between the adjacent environmental infringement and the environmental pollution infringement.
