行政伦理视角下城市房屋拆迁问题的研究

摘要
城市房屋拆迁是一个国家城市化、现代化过程中必然产生的现象。近些年来,随着我国经济和社会发展的快速需求,我国城市拆迁的规模总量和动迁量很大,由此也出现了城市拆迁矛盾与纠纷日益频发的现象。例如重庆“最牛钉子户”事件,天安门的自焚事件,湖南嘉禾事件等等。从众多矛盾和纠纷可以发现,除少数被拆迁户无理索求外,大多问题都出现在所征土地用于商业性改造或带有商业成分的改造中,特别是商品房建设项目,而公益性拆迁由于拆迁改造目的单一很少出现类似问题,因此本文就主要研究因商业性用地需要而进行的城市房屋拆迁。
种种矛盾和纠纷不断出现,深究其原因,无不与政府的职能息息相关。涉及到政府在商业性拆迁过程中相关制度的建设是否完善合理、政府角色是否正确定位以及行政人员的职业伦理建设等问题,这些都无不透射出城市房屋拆迁中行政伦理建设的紧迫性。因此研究城市房屋拆迁中的行政伦理建设就具有一定的现实意义和实际应用价值,建议从以下几个方面去进行城市房屋拆迁中的行政伦理建设。
第一,加强制度与政策的伦理建设,将伦理规范运用于公共政策制定过程、执行过程、评估过程中,使伦理规范被行政组织和行政人员普遍接受并对公共政策活动作出善恶判断。注重制度的伦理化和伦理的制度化,使行政行为有章可循,使制度具有一定的灵性性和可操作性,并使行政人员手中的“公权”没有套现空间,做到公私分明,保护拆迁当事人的合法权益。
第二,注重政府自身伦理建设,保证在城市房屋拆迁中政府角色的正确定位,改变既当裁判员又当运动员的角色,扮演好被拆迁人基本权利的保护者、双方协商和公众参与的促进者、拆迁纠纷的调停者、城市拆迁的规划者等角色。
第三,重点加强行政人员的职业伦理建设。营造一个相信行政人,尊重行政人的社会文化氛围,构建一个有利于督促行政人员自我不断向上的制度体系和组织环境,使行政人员产生真正的内心德化并对行政环境及其存在的价值基础有着清醒的认知,产生严格的行政职业伦理自律。只有这样,才能保证城市房屋拆迁中的公正、公平,拆迁纠纷的减少,保证城市化进程的顺利有序进行。
It is a phenomenon that the urban housing demolition must be produced in the course of national urbanization and modernization. In recent years, with the fast demand for economic and social development of our country, the total scale and amount of demolition are very big in our country. So it appear many demolition contradictory frequently day by day. Such as "the most rule recalcitrant" incident in Chongqing, the self-burning incident in Tian An-men, Jiahe incident in Hunan,etc. From these contradictions and dispute,we can found except that few is demanded unreasonably by relocation household, most questions appear in the land solicited is used the commercial transformation or transformationed with commercial composition, especially the construction project of commodity apartment, and the demolition for public interests seldom presents the similar question because its singly, so my thesis deponds on studying the urban housing demolition for needing the land used for commerciality.
To appear while being constant all sorts of contradictions and disputes, the reason of going into seriously,it is closely related with the function of the government.such as it is relevant with whether the construction of relevant systems is complete and rational and whether the role of the government is reasonable in the commercial removal, and it is relvant the constraction issue of Administrative personnel's ethics,etc. all these penetrates reflect the urgency of administrative ethics in urban housing demolition all without exception. So we should pay attention to the construction of administration ethics in the urban housing demolition.
First, we should strengthen the building of the institutional and policie of Ethics,and make the ethical standards applied to the public policy-making process, implementation, and evaluation process, and make it accepted generally by administrative organization and administrative staff, and use it to judge the public policy activities is good or evil. the ones that pay attention to ethics and ethics of the system are institutionalized, to make administrative behavior have regulations to abide by, and make the system have certain intelligence nature and effectiveness, and make "the public right" of administrative personnel have not discount space, accomplish to make a clear distinction between public and private interests, protect the legitimate rights and interests of pulling down parties.
Second, we should pay attention to construction of government own ethics in order to guarantee the role is reasonable in the urban housing demolition, and change the government role who works as referee and athletes both, it shoule act as the protector role of pulled down people's fundamental right,and consult and promoter, intervener of both sides, and the planner in the housing demolition.
Third, we should strengthen the job ethics construction of the administrative personnel job ethics. To Build one and believe the administrative person, respect the social culture atmosphere of administrative people, it helps to supervise administrative personnel's self-constantly upward system and organise the environment to construct one, it will make the administrative personnel produce real morals and have sober cognition to the administrative environment and value foundation, produce strict administrative job ethics to contain by oneself. Only in this way, could guarantee the fairness, justice, and reduce the dispute in the urban housing demolition and guarantee a smooth urbanization process and go on in order.
