道路交通事故处理法规研究

摘要
道路交通事故处理法规尤其是《道路交通事故处理办法》自实施以来，在保护当事人合法权益、维护社会安定等诸方面做出巨大的贡献。但是，由于道路交通事故处理法规所调整的社会关系和对象在市场经济条件下发生很大的变化，许多法规渐渐滞后于道路交通的发展形势，并直接影响到事故处理的公正性、公平性。本文立足道路交通事故处理现状，分析道路交通事故处理中行政处罚种类和幅度设定中存在的问题，论证民事损害赔偿调解移交法院管辖所具备的优势和法律依据，研究非法定义道路的交通事故处理等专题内容，着重探讨道路交通事故中实行精神损害赔偿的合法性和可行性，介绍部分国家和台湾地区的强制汽车责任保险制度，阐述通过完善汽车保险体制在损害赔偿中实现无过错责任原则以及建立社会救助基金的观点，旨在建议以立法的方式改革当前的事故处理机制，保证事故处理程序公正，保障事故受害人得到应有的赔偿。
In enhances to protect concerned people's individual rights and benefits, to maintain public order that the relative road traffic accident handling laws and regulations, especially the Road Traffic accident Handling is put into implementation. As the public relationship and individuals concerned have changed a lot under the influence of the development of the economic status and the market, regulations which are out of time have been legged behind the road traffic developing, that influences the fairness and conciseness of the accident handling.
Upon the present situation of road traffic accident handling, this article is trying to analyze problems existed in administrative punishment for road accident handling, to demonstrate advantages and law items for transferring individual loss compensation to court for handling, to study various illegal definitions for road traffic accident, to emphasize on discussing feasibility of spirit loss compensation, to introduce mandatory vehicle responsibility insurance systems from some other countries and areas especially Taiwan, to set up a point of view that there isn't any responsibility or false action in an accident and loss compensation needs social financial foundation aid by complementing vehicle insurance system, to suggest reforming the present traffic accident handling system by drafting relative law, to make the handling procedure fair and public and to ensure the concerned individuals are compensated reasonably.
