精神病罪犯管理研究
摘要
精神病罪犯管理对提高监狱监管安全水平和罪犯改造质量有着重要的意义,由于法律法规、经费保障、医疗水平和管理观念等因素的影响,现阶段我国监狱系统的精神病罪犯管理工作还存在诸多问题,而且已经不同程度的影响到监狱整体工作的发展,深入研究和分析这些阻碍监狱发展的因素并研究相应对策,对提高精神病罪犯管理水平有着重要的意义。
本文以江苏省监狱系统的实践为例,采用文献研究法、问卷调查法、访谈法和实证分析法等方法系统的分析了江苏省监狱系统精神病罪犯管理工作存在的问题及其产生的原因,提出了加强精神病罪犯管理的途径和对策。
本文通过对江苏省监狱系统精神病罪犯管理的现状、存在的主要问题及其原因的分析,提出了实现监狱精神病罪犯管理目标的两条途径,一是规范化建设,二是社会化建设;提出了监狱精神病罪犯管理水平提高的几项措施:严把进口、规范管理、畅通出口、加强危机公关建设。
本文结合江苏省监狱系统的实际情况,运用新公共管理理论、新公共服务理论、目标管理理论重点阐述了监狱精神病罪犯管理工作的发展方向、具体目标和具体对策。本文认为,监狱精神病罪犯的管理的目标就是维护监狱监管安全,提高精神病罪犯改造质量。这就要求我们必须不断提高精神病罪犯管理工作的水平和效能,在内规范各项工作的管理,在外积极利用各项社会资源。必须严格控制精神病罪犯的收押,规范精神病罪犯的管理,推进精神病罪犯的减刑假释和保外就医,建立科学合理的流转程序,并且做好危机公关工作,只有这样才能取得实效,才能为服务监管安全和提高罪犯改造质量奠定坚实的基础。与此同时,监狱必须为在押精神病罪犯提供必要的医疗服务,确保其得到及时合理的康复和治疗;监狱精神病罪犯的管理需要建立自身目标考核体系,奖优惩劣,促进监狱相关资源有效使用。
Psychiatric criminals management on improve prison regulatory security level and criminals reconstruction quality has important of significance, due to legal regulations, and funding protection, and medical level and management concept, factors of effect, at this stage in China prison system of psychiatric criminals management work also exists many problem, and has different degree of effect to prison overall work of development, in-depth research and analysis these hinder prison development of factors and research corresponding countermeasures, on improve psychiatric criminals management level has important of significance. In this paper, the prison system in Jiangsu Province as an example, literature research method, questionnaire surveys, interviews, analysis and empirical analysis system by the mentally ill offender management work in the prison system in Jiangsu Province and the cause of the problem. And according to the new public management theory, such as the new public service theory, goal management public administration theory and the analysis of specific development direction and target of the mentally ill offender management.
Think of this article, we must strictly control the confinement of mentally ill offenders, standardizing the management of mentally ill offenders, advance the commutation and parole and medical parole of mentally ill offenders, establish scientific and reasonable transfer programs, and public relations work, so as to achieve tangible results, to monitor security for a service and lay a solid foundation for improving the quality of reforming criminals. This article on the mentally ill offender management present situation investigation of the prison system in Jiangsu Province, using the new public service theory and the theory of new public management theory, goal management theory drawn the conclusions. Prisons must be in custody of mentally ill offenders to provide the necessary medical care, rehabilitation and treatment to ensure their timely and reasonable; prison management needs to establish their own goals of mentally ill offenders assessment system, awards and punishing bad, and promoting effective use of prison-related resources; prison of mentally ill offenders management goal is to maintain prison security, improve the quality of mentally ill offenders reform. This requires we must continually increase of mentally ill offender management levels and effectiveness, regulate our work within management, actively utilizing social resources.
Through the prison system in Jiangsu Province of mentally ill offenders management analysis of current situation, main problems analysis of the causes, came to the two ways to achieve goals, is the standard construction, and the other is social construction, and finally to improve management level put forward several measures, namely strict standardized management, smooth flow of imports, exports, strengthening the construction of public relations. This article in the introduction to psychiatric research explains the background and significance of offender management, to review related research, and made a study of thought and methods. Chapter I, the concept has been defined and elaborated regarding the use of relevant theories in detail. Chapter II on the prison system in Jiangsu Province, it analyzes the current situation of the mentally ill offender management, and identified the main problem. Chapter III on the prison system in Jiangsu Province criminal management of major issues of the causes of mental illness.
