摘要
20世纪50年代以来,各国纷纷重视起海洋权益来,关于海洋的立法发展也极为迅速。联合国分别在1958年、1960年和1973年举办了海洋法相关会议。组织各国商讨海洋法相关议题,并对法条等内容进行制定。1982年,通过了《联合国海洋法公约》(以下简称《公约》)。至此,海洋法的发展进入了一个新的领域,世界各国的海洋探索和发展也进入了一个新的时代。为了适应我国时代发展的需要,推进深海的科学技术研究、资源调查,同时也为了尽到作为《公约》缔约国的责任,我国与2016年2月26号通过了《中华人民共和国深海海底区域资源勘探开发法》(以下简称《深海法》)12,并于2016年5月1日正式开始执行。《深海法》的制定,弥补了我国深海海底区域资源勘探相关立法的不足,适应了海洋形势发展需要,既是引领海洋事业发展的里程碑,也是加速推进海洋事业发展的助推器。《深海法》的出台,是中国肩负起《公约》中大国责任的体现,提升了我国在国际上的话语权,顺应了整个时代发展的潮流,对我国有着重大的意义。本文主要介绍了《联合国海洋法公约》与我国《深海法》之间的联系,作用及相互之间的影响等,希望能对我国法制建设有所帮助。
Since the 1950 s, countries have paid attention to marine rights and interests, the legislation on the development of the ocean is also extremely rapid. The United Nations held relevant meetings on the law of the sea in 1958, 1960 and 1973, respectively. Organizations of countries to discuss issues related to the law of the sea, and the law and other content to develop. In 1982, the United Nations Convention on the Law of the Sea(hereinafter referred to as "the Convention") was adopted. At this point, the development of the law of the sea has entered a new field, the world's marine exploration and development has entered a new era. In order to meet the needs of the development of our times, to promote deep-sea scientific and technological research, resource survey, but also to fulfill the responsibility as a party to the Convention, China and February 26, 2016 adopted the "People's Republic of deep seabed regional resource exploration Development Law "(hereinafter referred to as " deep sea law "), and in May 1, 2016 officially began. "Deep Sea Law" to make up for China's deep seabed regional exploration of resourcesrelated to lack of legislation to adapt to the needs of the development of the marine situation is not only a milestone in leading the development of marine industry, but also accelerate the development of marine industry booster. The introduction of the "Deep Sea Law" is a manifestation of China's commitment to the responsibility of the big powers under the Convention. It has enhanced China's international discourse power and conformed to the trend of development of the entire era. It is of great significance to China. This paper mainly introduces the relationship between the United Nations Convention on the Law of the Sea and China's Deep Sea Law, and the mutual influence between them. It is hoped that this will help China's legal construction.
