我国影视行业演员薪酬的政府规制研究

摘要
目前治理影视行业演员薪酬面临着立法规定粗疏与税收管理乏力的问题。为破解演员薪酬治理困境,需要引入政府规制。在市场失灵出现与行业自治不足的情况下,政府规制具有必要性;在符合比例原则要求和通过平等原则检验的前提下,政府规制具有合理性。为更好促进我国影视行业的良性发展,治理"天价薪酬"问题既要自我规制,又要政府规制,需要构建完善的政府规制体系。其中在规制依据上应加快薪酬管理法律体系建设;在规制主体上应采取多方合作治理的新思路;在规制措施上应综合运用多种手段共同发力。
The phenomenon of "sky-high salary" has been in our country for a long time and is very harmful to the development of the film and television industry.At present,the governance of film and television industry actors' salary faces the problem of the rough legislative provisions and weak tax management:at the legislative level,the "salary limit order" has the dual attributes of trade autonomy norms and the administrative normative documents,but the implementation is not good;at the level of tax management,presenting the chaos of "Yin and Yang contract" tax evasion and tax avoidance in tax depression.In order to solve the governance dilemma of actors' salary,it is necessary to introduce government regulation.Government regulation is necessary in the existence of market failure and the lack of trade autonomy;government regulation is reasonable under the premise of meeting the principle of proportionality and testing through the principle of equality.In order to better promote the benign development of the film and television industry in China,solving the problem of "sky-high salary" requires both self-regulation and government regulation,and this requires a sound government regulation system.Among them,in the regulation basis,the salary management legal system should be accelerated;in the regulation body,the new thinking of multi-party cooperation should be adopted;in the regulation measures,various measures should be used together.
