摘要

我国保险法第52条规定了危险增加的通知义务,它体现了保险法中最大诚信原则及对价平衡原则,在处理保险合同纠纷中发挥着重要作用。但还存在诸多不足,有必要进一步补充和完善,如扩大危险增加通知义务的适用范围、增加通知义务的履行主体、厘清通知义务的履行时限、明确危险显著增加时保险人预见或应当预见的范围及违反法律规定的后果等。
        Article 52 of China's Insurance Law stipulates the obligation to notify the increase of danger. It embodies the principle of maximum good faith and the principle of balance of price in the insurance law,and plays an important role in handling insurance contract disputes. However,there are still many deficiencies,and it needs to further supplement and improvement,such as expanding the scope of application of the notification obligation of increasing risk,increasing the performance subject of the notification obligation,clarifying the time limit for fulfilling the notification obligation,and clarifying the scope of the foresight or foreseeable by the insurer when the risk increases significantly,as well as the consequences of violation of the law.
