摘要

征地拆迁矛盾随着城市化进程的加快而日益突出,特别是集体土地征收补偿纠纷不断,影响社会的安定和谐。如何有效地解决集体土地征收补偿过程中出现的公共利益界定不清、补偿安置方案的作出主体不适格、利益分配不合理、宅基地征收困难以及征地纠纷救济机制不力等问题,是建立科学公正的利益调处机制的关键。
        The contradiction of land expropriation and demolition becomes more and more prominent with the acceleration of urbanization,in particular,the disputes of collective land expropriation and compensation continue to occur,which have affected social stability and harmony.It is the key to establish a scientific and just interest adjustment mechanism to solve the problems from collective land expropriation compensation effectively,such as unclear definition of public interest,inappropriate compensation settlement scheme identity,unreasonable distribution of benefits,difficult expropriation of rural homestead,and poor relief mechanism for land expropriation disputes.
