我国专利当然许可制度的构建
摘要
专利的当然许可制度对促进专利的实施具有非常重要的意义。专利的当然许可是一种非自愿许可;在我国,对于当然许可的条件,应当由双方协商,不能达成一致意见的,由专利管理部门确定;对于实施当然许可的专利,暂不应给予专利年费的减免优惠;适用当然许可的专利涉及侵权赔偿时,赔偿范围应包括权利人所有的实际损失,实际损失不好确定时,许可费可以作为赔偿数额的参考;当然许可合同不以登记为要件,但不能对抗善意第三人。
The patent license of right system is of vital meaning to patent implementation. Patent license of right is a kind of non-voluntary license. In China, conditions of license of right should be negotiated by both parties. If consensus can't be reached, the patent administrative organs will decide on the conditions. For the time being, it is not recommended to give annual patent fee exemption to patents practiced under license of right. When patents under license of right commit infringement, the damages should cover all actual damages incurred to the proprietor. If the actual damages are unable to be measured, license fees can be used as a reference. Nonregistered license of right contract is valid, but can't be used as a defense against the bona fi de third party.
