论网络信息技术与民事诉讼程序的新发展

摘要
网络信息技术自诞生伊始,便对社会生活产生了显著的影响。网络信息技术的飞速发展,使人们获取、处理、传送信息的模式发生了转变。信息交流的模式包括从网络上感知文字、图片、声音等方式,并且实现了跨时空的传递和交互。网络信息技术在深入影响经济社会发展的同时,也融入民事诉讼程序的发展,在案件审理、证据制度、送达制度、庭审制度等方面均有不同层面、不同程度的应用。随着技术的发展,民事诉讼程序可在受案范围、裁判智能化、裁判文书公开方面探索进一步革新的空间。
Since the birth of network information technology, it has had a significant impact on people's life. The rapid development of network information technology has changed the mode of information acquisition, processing and transmission. The mode of information exchange includes perceiving words, pictures and sounds from the Internet, thus realizing the transmission and interaction across time and space. The network information technology has deeply affected the economic and social development, and has been integrated into the development of civil proceedings. It has been applied to case trials, the evidence system, service system,and court trial system to varying degrees and at many levels. With the development of technology, civil procedure can explore making further innovations in the areas of opening cases, intelligent adjudication and publicity of judgment documents.
