婚姻自由的法内和法外:现行婚姻法的立法缺陷及完善

摘要
在近代发展过程中,西方婚姻法中关于男女平权、婚姻自由的思想也逐渐流入中国。在新时代,个体婚姻逐渐脱离了以生育为目的的长效期、互补性投资,整体社会婚姻也逐步脱离了养老保险、医疗保险的性质。为充分体现社会主义婚姻家庭体现中婚姻自由的优越性,应利用社会道德机制对婚姻关系缔结双方的权利、职责进行约束。加强婚姻自由法律的应用,充分保证我国公民婚姻自由权利。
In the process of modern development,the western law' of marriage thoughts on the equality of men and women and the freedom of marriage gradually went into China. In the new era,individual marriage is gradually separated from long-term and complementary investment aimed at fertility,and the overall social marriage is also gradually separated from the nature of endowment insurance and medical insurance. In order to fully embody the superiority of the freedom of marriage in the socialist marriage and family,the social moral mechanism should be used to restrain the rights and duties of the two parties in the marriage relationship. We should strengthen the application of the law on the freedom of marriage and fully guarantee the right of Chinese citizens to the freedom of marriage.
