民商事域外取证中证人权益保障研究——以“一带一路”建设背景下对外贸易纠纷为视角

摘要
随着"一带一路"建设的不断推进,我国与沿线国家民商事交往更加密切,跨国民商事诉讼纠纷数量也逐年增长,其中域外取证是国际诉讼中关键的一环。由于各国所奉行的域外取证制度存在差异,取证时常会发生冲突,进而影响证人的权益保障。在详细阐述部分国家取证制度所存在的差异以及对证人权益保障领域的影响的基础上,从完善国内立法和加强国际间司法协助方面对证人权益保护提出建议。
"One Belt and One Road"has been pushed forward continuously. The exchanges between civil and commercial affairs in our country and those along the line have been closer. The number of litigation disputes among transnational civil and commercial affairs has also increased year by year. Forensic evidence extrapolation is a key part of international litigation. Due to the differences in the foreign forensic systems pursued by all countries,conflicts often occur during evidence collection,which in turn affects the protection of witnesses' rights and interests.On the basis of elaborating the differences existing in some countries' examination systems and how the differences have spread to the field of witness protection,this article tries to put forward suggestions on how to protect the rights and interests of witnesses in terms of perfecting domestic legislation and strengthening international judicial assistance.
