检察机关实施《国际刑事司法协助法》若干问题

摘要
根据新颁布的《国际刑事司法协助法》,最高人民检察院以及各级检察机关分别承担着刑事司法协助的联系机关、主管机关和办案机关的职能。刑事缺席审判中的文书送达将是检察机关面临的一个严峻课题,需要办案机关想方设法建立一些途径,疏通与境外犯罪嫌疑人、被告人的联系。在境外调查取证方面,检察机关应尽可能依照《国际刑事司法协助法》以及相关国际条约的规定派员到被请求国与该国司法机关合作调取证据,派员实地取证的效果将远远优于委托调查取证。检察机关在协助外国追缴资产时应当充分发挥《刑事诉讼法》规定的特别没收程序的作用,根据外国提供的、有关财物属于应当追缴的违法所得及其他涉案财产的证据材料向人民法院提出没收申请。在移入式移管被判刑人中,检察机关将负责依据我国法律和外国判决制作刑罚转换申请书,提请人民法院对被移管回国的服刑者作出刑罚转换裁定。
According to the newly promulgated Law on International Judicial Assistance in Criminal Matters,the Supreme People's Procuratorate and procuratorates at all levels assume respectively the functions of the liaison organ,the competent organ and the case-handling organ of international judicial assistance in criminal matters. In the aspect of overseas investigation and evidence collection,the procuratorial organs should,as far as possible,dispatch officers to the requested country to cooperate with the competent organs of that country in accordance with the provisions of the Law on International Judicial Assistance in Criminal Matters and relevant international treaties. The procuratorial organs should give full play to the special confiscation procedure stipulated in the Criminal Procedure Law when assisting foreign countries in recovering assets. They should apply to the court for confiscation on the basis of evidentiary materials provided by foreign countries which can prove that the property belongs to the illegal income that should be recovered. In the field of move-in transfer of sentenced person,the procuratorial organs will be responsible for making applications to the court for the conversion of penalties in accordance with Chinese laws and foreign judgments.
