八二宪法共和思想的文本梳理

摘要
共和思想与民主、宪政思想紧密相连,但又存在不同,具有自身的独立内涵和独立价值。八二宪法蕴藏着丰富的共和思想。通过对当代共和思想的挖掘,对八二宪法的共和条款进行类型化,在当代学者的思想基础上,提出了共和思想的五分法:和平、共有、共治、共享、和谐与均衡,试图为八二宪法的共和思想作出一个初步梳理。
Republic has a close relationship with democracy and constitutionalism,but there could be a difference.Republic itself has an independent meanings and value. 82 Constitution contains abundant thoughts of republicanism. Typing the republicanism clause of 82 Constitution by evaluating contemporary republicanism,based on thoughts of contemporary scholars,it gives a rule of fifths: peace,common,collegiality,share,harmony and balance,try to do a text comb on republican thoughts of 82 Constitution.
